Identify and address retaliation as a barrier to accessing DOL resources. Preventing and immediately addressing retaliation is critical to protecting the rule of law and workers' rights. Some employers silence victims and witnesses by strategically retaliating, which undermines law enforcement and obstructs justice. A nationwide survey found that 43 percent of workers who complained to their employers about pay and working conditions were victims of illegal retaliation. Immigrants - particularly undocumented immigrants - earning low wages are particularly susceptible to immigration-related threats of retaliation, such as threats to contact immigration enforcement agency personnel if complaints are not withdrawn. DOL should take proactive steps to identify, prevent, and immediately address employer retaliation against employees who report labor law violations.
