In addition to existing Affirmative Action Programs (AAP) requirements, the DOL should develop guidance stipulating that when awarding federal contracts and subcontracts, special consideration should be given to firms that either have a significant proportion of employees who come from communities that have been underserved or target their outreach for employment opportunities in part to communities that have been underserved. Other qualities of firms deserving special consideration are those whose recruitment policies do not limit enrollment based on factors such as pre-enrollment drug testing, history with the criminal legal system, documentation or citizenship status, non-payment of child support, or credit history.
