Advancing Worker Equity at U.S. DOL by Improving Enforcement Edited

Please see attached joint comments detailing the following recommendations:

For Migrant Workers

• Streamline and revitalize the employment service complaint system.

• Implement a policy of consistently communicating with SWAs about labor violations to ensure services are discontinued to employers who abuse the H-2A system.

Build strategic relationships with Community-Based Organizations

DOL's investment in strategic enforcement can have more impact if the agency partners with community-based organizations, which often serve as the trusted messengers for workers. Doing so can allow DOL to reach workers who would otherwise be inaccessible, such as: immigrant workers,... more »

Invest in a model of strategic enforcement

Invest in a model of strategic enforcement that can allow DOL to best utilize resources and become proactive in its investigations into compliance. Traditional enforcement is becoming less effective because of the changing nature of low-wage work, including growth of the gig economy and employee misclassification. Additionally, workers in industries with the most violations are often the most vulnerable to retaliation... more »

Farmworker Justice & UFW Foundation Priorities for Racial Equity

Almost every farmworker in the country falls into at least one—if not more—of the categories of underserved communities set forth in President Biden's Executive Order on Advancing Racial Equity and Support for Underserved Communities Through the Federal Government. Collect data who gets employed much like the census. Edited

In 2019, SBA reported that 132.9B (26.5%) went to small businesses, but despite the increase, the number of small businesses receiving contract awards was at a 10 year low and that is because we are working to meet a goal and not to increase participation.... more »
